TERMS AND CONDITIONS OF THE ONLINE STORE MYHOYA.SHOP
- General Provisions
These Terms and Conditions (hereinafter referred to as the "Terms") define the rules for using the online store available at https://myhoya.shop (hereinafter referred to as the "Store"), the rules for placing orders for products available in the Store, and the rules for concluding sales contracts.

The Terms are continuously available on the Store's website in a way that enables their reproduction and recording. Every Customer (a natural person, a legal entity, or an organizational unit without legal personality) making purchases in the Store is obliged to read the content of the Terms. The applicable language for all activities related to concluding sales contracts is Polish or English.
- Definitions
- Seller: Arkadiusz Sobczyk, conducting unregistered business activity at ul. Tylna 4E/61, 90-364 Łódź, Poland.
- Store: The online store available at myhoya.shop.
- Customer: Any entity making purchases in the Store.
- Consumer: A Customer who is a natural person purchasing for purposes not directly related to their business or professional activities.
- Terms: These terms and conditions, defining the rights and obligations of both the Customer and the Seller.
- Goods/Product: A movable item available in the Store’s assortment, subject to a sales contract.
- Sales Contract: A remote sales contract concluded between the Seller and the Customer, under the conditions specified in the Terms.
- Business Days: Days from Monday to Friday, excluding public holidays.
III. Rules for Using the Store
Customers are obliged to use the Store in a manner consistent with the law and good customs, respecting the personal rights and intellectual property of third parties.
Orders can be placed in the Store 24/7 throughout the year, but order processing is carried out on Business Days.
To use the Store’s services, the Customer should have:
- A device with internet access.
- A properly configured web browser.
- An active and properly functioning email account.
The Seller strives to ensure the Store operates correctly to the extent resulting from current technical knowledge and commits to remedying any irregularities reported by Customers within a reasonable time frame.
- Placing Orders and Entering into an Agreement
The subject of the sale is the Products presented on the Store's website at the time the Customer places the order.
The prices of all Goods presented in the Store:
- are quoted in PLN and EUR,
- do not include delivery costs, which are provided separately during the ordering process.
An order is placed by completing the order form available in the Store. The form must include details necessary for order fulfillment, such as name, surname, delivery address, email address, and phone number. The sales agreement is concluded when the Customer receives an email confirmation from the Store acknowledging the order. The Seller reserves the right to refuse to fulfill an order in justified cases, such as missing essential details, incorrectly completed form, unresolved payment, etc.
- Payment Methods
The Customer can use the following payment methods (depending on those available in the Store at a given time):
- electronic payment (fast transfers, card payments, etc.) – processed via an external payment system,
- traditional bank transfer – after placing the order, the goods will be reserved for you, and you will receive the bank account number to which the appropriate amount should be transferred via email. The transfer can be made online, at a bank branch, or via post.
In the case of traditional bank transfer payments, the Customer is required to pay for the order within 7 days from the date the order is confirmed by the Seller. The transfer title must include the order number. Once the payment is credited to the Seller’s bank account, the order is processed. Failure to pay within the specified timeframe may result in order cancellation.
- Delivery and Shipping Costs
The delivery of ordered Goods is available within the territory of the Republic of Poland and selected European Union countries.
Delivery can be executed through:
- a courier company.
Shipping costs depend on the chosen payment and delivery method. Information about shipping costs is displayed during the order process. The order processing time is typically 1 to 5 business days.
VII. Complaints and Warranties
The Seller is obligated to deliver Goods free from physical and legal defects. The Seller is responsible to the Customer if the sold Goods have a defect (warranty) under the provisions of the Civil Code.
If a defect is found, the Customer should promptly contact the Seller, describing the defect and the circumstances under which it occurred. Contact can be made:

The complaint should include:
- information and circumstances regarding the defect, particularly the date it occurred and the form of feedback desired,
- the request for how the Goods should be brought into conformity with the sales agreement or a statement about price reduction or withdrawal from the agreement,
- contact details of the person filing the complaint.
The Seller will respond to the Customer’s request within 14 days from receiving a correctly submitted complaint. If the Goods have an additional manufacturer’s warranty, information about it and its conditions will be provided for each Product in the Store.
VIII. Withdrawal from the Agreement
A Consumer who has entered into a distance agreement may withdraw from it within 14 calendar days without providing a reason.
The withdrawal period begins:
- for agreements where the Seller delivers the Goods – from the date the Goods are taken possession of by the Consumer or a third party designated by them (other than the carrier),
- for other agreements – from the date of the agreement.
To exercise the right of withdrawal, the Consumer must submit an unequivocal statement of withdrawal to the Seller. This can be done:

The Consumer may use the withdrawal form template but is not obliged to do so. Upon withdrawal, the agreement is considered void. The Seller will refund all payments received from the Consumer, including the cost of delivering the Goods (excluding additional costs resulting from the Consumer's chosen delivery method, which was not the least expensive standard delivery offered by the Seller), promptly and no later than 14 calendar days from receiving the Consumer's withdrawal statement. Refunds are made using the same payment methods used by the Consumer unless the Consumer explicitly agrees to another solution. The Consumer bears only the direct cost of returning the Goods unless the Seller agrees to bear these costs or fails to inform the Consumer about the need to bear them. The Consumer is responsible for any reduction in the value of the Goods resulting from use beyond what is necessary to establish their nature, characteristics, and functioning.
- Personal Data Protection
The administrator of the Customers' personal data is Arkadiusz Sobczyk, conducting unregistered business activity at ul. Tylna 4E/61, 90-364 Łódź.
Personal data is processed for the purpose of order fulfillment, settlements, handling complaints, and contacting the Customer regarding the sales agreement.
Providing personal data by the Customer is voluntary but necessary for order fulfillment. Failure to provide the data will prevent the agreement from being executed.
The Customer has the right to access their data, correct it, request its deletion, or demand its processing be stopped.

- Final Provisions
Agreements concluded through the Store are in Polish and governed by Polish law.
For matters not regulated in these Terms and Conditions, the applicable legal provisions, particularly the Civil Code and the Consumer Rights Act of May 30, 2014, shall apply.
The Terms and Conditions come into effect on the date of publication in the Store and remain in force until revoked or amended. Customers will be informed about changes via the Store's website.
Any disputes arising in connection with these Terms and Conditions will be resolved amicably. In the absence of an agreement, the competent court to resolve the dispute will be the common court determined according to the applicable regulations.
The Terms and Conditions are available free of charge in electronic form on the Store’s website. It is possible to familiarize yourself with its content, print it, save it, and reproduce it.
